Terms of Service for Exchange Hotel & Mossman Backpacker Resort

Welcome to our terms of service! By using our services, you agree to the following terms and conditions:

1. Users must be at least 18 years old to book a room.

2. Payment is required at the time of booking.

3. Cancellations must be made at least 48 hours in advance to receive a full refund.

4. Check-in time is 3:00 PM and check-out time is 10:00 AM.

5. There is no smoking in any of the rooms or a deodorising fee and termination of contract may apply. Ashtrays are provided downstairs in the designated smoking area, also known as the Beer Garden. 

6. Pets are not allowed on the premises.

7. Upstairs is our accommodation and relaxation areas, please keep noise to a minimum to ensure all guests are respected. The games room and beer garden are social spaces where noise will be less of an interruption to others. Failing to adhere to this will result in termination of your residential agreement. 

8. There is a kitchen provided for guest use only, please consider other guests that may wish to use the kitchen and wash any dishes that you may use.

9. There is to be no cooking food in your rooms. Please use the kitchen provided. Potential fire is our biggest concern and hazard. 

10. When leaving your room, please ensure all doors are securely locked, switch off lighting, air cond and water to conserve resources and avoid damage.

11. Please advise the manager immediately of any repairs required or damage to your room.

12. The room must be vacated, and the keys returned to the manager or bar staff by 10:00 AM on the departure date, unless prior arrangement has been made with the manager. Failure to depart on time may incur additional charges.

13. Guests are responsible for keys and loss of keys will incur additional charges.

14. Any non residents invited by our in-house residents will be under the invitees responsibility. If any issues arise with invited guests may result in immediate termination of your contract and stay with us.

Terms and Conditions:

1. Cleaning Responsibility: The Tenant agrees to maintain their rented room in a clean and tidy condition. Cleaning equipment, including a vacuum cleaner, is provided for Tenant use. The Tenant is responsible for laundering their own sheets and towels during their stay.

2. Use of Goods: The Tenant shall ensure that all goods provided, such as crockery, cutlery, etc., remain within the shared kitchen and are not shared with other accommodations or removed from the premises.

3. Rubbish Disposal: The Tenant agrees to dispose of all rubbish in the designated bins provided by the Landlord, bins are signed accordingly. 

4. Exterior Cleaning: The Tenant agrees to keep the exterior of their room clean and tidy. Failure to do so may result in a $300.00 cleaning fee, which will be deducted from the Tenant's deposit or and future payments.

5. Security Responsibility: The Tenant is responsible for the security of their room. All external doors, balcony doors (if applicable), and windows must be secured when the Tenant is not present. The Landlord shall not be liable for any loss of personal belongings.

7. Bedding and Linens: The Tenant will be provided with one set of sheets and pillowcases upon check-in.

8. Use of Furniture: The Tenant agrees to use only the furniture provided within their room and shall not remove or add any other furniture to the room from elsewhere in the resort.

9. Room Inspection: The Landlord reserves the right to inspect the room at any time for cleanliness and presentation.

10. Consumables: The Tenant is responsible for providing their own consumables, including but not limited to toilet paper, shampoo, and other personal care items.

11. Energy Conservation: The Tenant agrees to turn off the air conditioner and all electrical appliances when not in the room. A penalty of $50.00 per day applies for unnecessary use of the air conditioner, especially when going away overnight.

12. Common Area Fan: The Tenant shall keep the fan in common areas on at all times to ensure proper air circulation and prevent the growth of mold.

Termination of Tenancy:

1. Termination Notice: This tenancy agreement can be terminated by either party with one (1) months' notice in writing.

2. End of tenancy: It is agreed that should tenancy end, at the initiation of either party, the room of which you reside will be inspected prior to bond being reimbursed. 

Code of Conduct:

Please adhere to the following Code of Conduct during your tenancy:

1. Respectful Behaviour: Do not use language or engage in behaviour that may cause offense or discomfort to other residents or guests on the property.

2. Non-Discrimination: Do not engage in behaviour that may be seen as discriminatory, including but not limited to discrimination based on sexual orientation, religious beliefs, race, or gender.

3. Drug Policy: Do not bring or use illicit drugs on the premises, in compliance with the Residential Tenancies Act and the Misuse of Drugs Act.

4. Property Care: Do not wilfully or negligently damage or remove any property belonging to the resort.

5. Harassment: Do not engage in any form of harassment, whether physical or verbal, towards others on the premises.

6. Stealing Prohibition: Taking anything from resort supplies, including but not limited to food, drinks, toiletries, stationary, cutlery, or utensils, is considered stealing and is strictly prohibited.

Visitors:

1. Visitor Policy:

Visitors are welcome (without access to locks and/or door key codes) but must not stay overnight. Please greet your guest at the locked front side gate. Prior approval from onsite managers is required for the aforementioned. After approval, please ensure your visitor has read our terms of service as they are your responsibility as your guest. 

Fire:

1. Fire is our biggest enemy at this venue. Built in 1896 we are nothing but timber. Please be vigilant with smoking (candles, incense and others) OR open flame OR heating objects OR only to be used OUTSIDE.

Maintenance:

1. Maintenance Requests: For maintenance requests related to accommodation must promptly notify the Property Manager.

Reporting Damage:

1. Damage Reporting: Any damage to the property must be reported to the Manager. The tenant is liable for any damage caused to the property by themselves and/or visitors. 

Routine Inspections:

1. Inspections: Mossman Exchange Hotel will conduct routine inspections of the property. You will be advised to rectify any unsatisfactory items as notified to you.

Tenant Details:

1. Change of Circumstances: The tenant must promptly advise Mossman Exchange Hotel of any change in their circumstances. The Property Manager is the best contact for this. 

Domestic Pets:

1. Pet Policy: No pets are permitted in any accommodation rooms unless approved prior with Nathan. 

Smoking:

1. No Smoking: Smoking inside your accommodation is strictly prohibited due to health/safety/fire hazards. Please use designated outdoor areas and dispose of butts in ashtrays provided. smoking areas are only in the beer garden.

Property Misuse:

1. Proper Use: The accommodation provided is for personal living space outside of common areas. As this is the venues property, tenants must not misuse the property for any activity other than personal living, including illegal purposes.

Additional Notes:

Security: Security doors with access codes must remain closed and locked at all times for the safety and security of all residents.

Rent Payments/Bond:

Four weeks of rent is payable in advance and a $**** bond is required upon signing of this agreement. This provides you with the following extras; aircon remote, X2 keys, bed linen, mattress protector. In order to get bond back these items including the room must be given back along with a new mattress protector (cheap from kmart). Please note: As this contract is a month to month contract please be advised that your rent may change. You will be given a min of one week's notice prior to this happening. 

Breach of Agreement:

Failure to adhere to any part of this tenancy agreement, whether outlined in writing or communicated verbally by Management, will constitute a breach of the agreement and may result in the termination of your tenancy before the finalization of your current contract.
